Howell asks for emergency injunctive relief for a restraining order against the defendants.1.The D.R.B.A. administrative process in Mr.Howells termination of employment has caused Mr.Howell to be Deprived of his rights under the color of law.The D.R.B.A has labeled Mr.Howell a disgruntled Former employee who may possibly attack the D.R.B.A facilities and employees.A security contractor or consultant is providing the "security" services forD.R.B.A .Emergency management of Cape May county has knowledge of this matter.Exhibits and factual evidence to support this request are being provided by Mr.HowellMr.Howell pleading will be described in two parts1. Delaware River and Bay authority2.Tetra Tech EM-----------------------------------------Part 1----- < -D.R.B.A->1.) Detective. ,or "Staff Seargant" Rob Miller falsified or fabricated information about his interview with James Howell at the Cape May Troop #3 administrative building on October 27, 20091.) Detective Miller stated Mr.Howell was aggresive and challenged him during that interview.2.) Mr.Howell was read his Miranda rights.3.) The interogation or interview was audio tape recorded by Detective Miller.4.) Detective Miller committed perjury at a sworn under oath testimony as a witness against Mr.Howell at a judicial post termination proceeding that was sworn under oath,transcribed and audio recorded.Proceeding was held at the Vincent Julia Building Delaware Memorial Bridge on July 12, 2010. This is a violation of18 U.S.C. § 1001Exhibit#1- report by detective Miller that states he audio recorded Mr.Howell at 15:06 hours on October 27th 2009.2.Exhibit#2- actual pages of Detective Millers sworn under oath testimony as a witness against Mr.Howell at the post termination judicial hearing on July 12,2010.The proceeding was held at the Vincent Julia building at the Delaware Memorial Bridge.3.) Exhibit#3- subpoena for the audio tape recording from the D.R.B.A police records and evidence department.1.-a) Thie subpoena is evidence that Detective Miller committed perjury and falsified what occured when he interviewed Mr.Howell.4.)exhibit #4-audio tape recording on compact discWith a detail explanationThis is in the courts possesion.This is evidence that supports Mr.Howells complaint.It identifies the coercive actions by the D.R.B.AThe recording is evidence that Mr.Howell is not a threat.-5.) Mr.Howell received the decision from his post termination hearing in August 2010.That document contained a forged or false signature.Hearing panelist Mr.Richard Fressettos signature was not authentic.The signature was a cut out from a document and was glued in the place of his signature.Mr.Howell has provided a picture of that document.The court has that document. A copy of a document that contains a forged signature.The D.R.B.A abuse of police power, and post-termination judicial proceeding was amalicious abuse of process; Violations of 42 U.S.C. 1983:VIolation of 18 U.S.C. § 1001 :Mr.Howell was denied access to his records from Nj Dept of Homeland security NJ OPRA REQUEST #W6500. on April 26, 2012 ,Mr Howell received assistance from the NJ Government records council to appeal the denial of access to his records and mediate for themMr.Howell was still denied mediation and access.to those records that final decision June 29 2012.There home is being forclosed on.Utilities are being shutoff due to Mr.HowellsMr.Howells debtors have filed civil actions against him.Mr. Howell cannot provide for his family and pay his debtors while the Defendants engage in this counter terrorism tactics against Mr.Howell.Mr.Howell is traumatized, and complacent due to this matter.Mr.Howells due process rights have been violated.The military hazard Mitigation or counter terrorism is endangering the safety and welfare of Mr .Howells family., and degraded and disrupted Mr.Howells childrens quality of life.Mr.Howell is being obstructed from obtaining employment.Mr.Howell is engaged during attempts to obtain gainful employment employment at Nj state job services.That is a violation of a federally protected right.The security contractor has been granted authority to engage in counter terrorism offensive actions against Mr.Howell .Continous unathorized entry into Mr.Howells Home.Tampering with the food in their home.Privacy violations by the devices installed on the utility poles infront of Mr.Howells homeThe military hazard mitigation or counter terrorism has Deprived Mr.Howell of his rights under the color of law. Title 18 U.S.C. § 242,Mr.Howell has been denied equal protection of law. Section 1981 of Title 42 (Equal Rights Under the Law)Mr.Howell and his wife have filed complaints with Lowertownship police,They denied knowledge of the Security contractors actions and denied Mr.Howells complaint about harassment ,stalking, vandalism, and cell phone interception by the defendants.The counter terrorism is being engaged against Mr based on falsified records and reports.The records are maintained by the NJ OHSP.Mr.Howell has been denied access to those records.NJ OPRA request was filed by Mr.Howell to the Nj OHSP April 24, 2012 for records or information about himself.Mr.Howells request was denied.Mr.Howell was assisted by the NJ government records council to mediate for those records.Mr.Howell was denied accessThe final decision was given on June 29 2012 byMary Beth Wood,Senior deputy attorney general ,assistant section chief state police groupDivision of Law.The following specific explanation of the exemptions are relative to this request.HSP DOC# 0424121-DENIAL #37. Domestic security.HSP DOC# 0424122-Exemption #4.Trade secrets and proprietary commercial or financial information obtained from any source. For the purposes of this paragraph, trade secrets shall include data processing software obtained by a public body under a licensing agreement which prohibits its disclosure .HSP DOC# 0424124-Exemption # 7.Emergency or security information or procedures for any buildings or facility which, if disclosed, would jeopardize security of the building or facility or persons therein.///.Exemption #7 is relevent to Mr.Howells Complaint.The D.R.B.A has falsified information or records about Mr.Howell labeling him a threat.THe records have been used for the D.R.B.A. ""emergency and security to reside in residences within 300 ft of Mr.Howells Home to engage in counter terrorism against Mr.Howell.This is a due process violation and also a violation of TITLE 18 - CRIMES AND CRIMINAL PROCEDURE PART I - CRIMES CHAPTER 47 - FRAUD AND FALSE STATEMENTS SECTION 1001Mr.Howell has not been questioned by law enforcement or any other entity.Mr.Howell has no criminal history.
