This week the UN Human Rights Committee has issued recommendations to the Governments of Namibia, New Zealand, Rwanda, South Africa, and Sweden to reform and strengthen surveillance and privacy protections.
The Committee recommendations touch upon some of the fundamental issues of surveillance powers and the right to privacy, including mass surveillance, retention of communication data, judicial authorisation, transparency, oversight, and regulating intelligence sharing.
These recommendations are yet another confirmation that the human rights provisions contained in the International Covenant on Civil and Political Rights provide an effective framework to assess whether modern communication surveillance laws and practices comply with the right to privacy.
Now the ball is in the Governments’ court. Will they choose to reform their surveillance laws and subject interception to judicial authorisation and oversight? Will they protect and treat personal data in accordance with human rights standards, and without discriminating between nationals and non-nationals? Will they adopt comprehensive and effective data protection regimes?
Namibia
The Committee noted with concern that interception centres seem operational despite a lack of clear legal basis, as well as the lack of clarity regarding the reach of legal interception possibilities and the safeguards to ensure respect of the right to privacy in line with the International Covenant on Civil and Political Rights.
New Zealand
The Committee echoed Privacy International’s concerns about New Zealand communications surveillance, namely the lack of safeguards in the interception of so-called foreign communications.
The Committee recommended that “sufficient judicial safeguards are implemented, regardless of the persons’ nationality or location, in terms of interception of communications and metadata collection, processing, and sharing”, confirming previous concluding observations by the Committee for countries like the UK and the US.
Rwanda
The Committee expressed concern that the law regulating the interception of communications permits the interception of communications without prior authorization of a judge. The Committee recommended that “the interception of communications and use of data take place on the basis of specific and legitimate objectives and that the categories of circumstances in which such interference may be authorized and the categories of persons likely to be intercepted are set out in detail. It should also ensure the effectiveness and independence of a monitoring system for interception, in particular by making provision for the judiciary to take part in the authorization and monitoring of the interception.”
South Africa
Privacy International, together with the South African campaign Right2Know and the Association for Progressive Communications, raised significant concerns about the laws, policies, and practices surrounding surveillance by intelligence and law enforcement agencies.
The Human Rights Committee was concerned “about the wide scope of the data retention regime” and “at reports of unlawful surveillances practices, including mass interception of communications, carried out by the National Communications Centre”. It called on South Africa to “take all necessary measures to ensure that any interference with the right to privacy complies with the principles of legality, necessity and proportionality”.
Further, the Committee called on South Africa to “refrain from engaging in mass surveillance of private communications”, to “consider revoking or limiting the requirement for mandatory retention of data by third parties” and to “increase the transparency of its surveillance policy and speedily establish independent oversight mechanisms to prevent abuses and ensure that individuals have access to effective remedies.”
These recommendations should form the blueprint for a long overdue reform of surveillance laws in South Africa. It is now up to the Government to show that it is acting in good faith to implement its obligations under international human rights law by engaging South African civil society, and beginning the reform process.
Sweden
Despite the Swedish Government’s reassurance, the Human Rights Committee remained concerned “about the limited degree of transparency with regard to the scope of these surveillance powers [under the Signals Intelligence Act], and the safeguards on their application.” And - reflecting a concern shared by Privacy International, Civil Rights Defenders and DFRI - it criticized “the lack of sufficient safeguards against arbitrary interference with the right to privacy with regard to the sharing of raw data with other intelligence agencies”.
The Committee called for increased “transparency of the powers of, and safeguards on the National Defence Radio Establishment (Försvarets Radioanstalt - FRA), the Foreign Intelligence Court and the Data Inspection Board” including “by considering to make their policy guidelines and decisions public”.
Notably, the Committee confirmed that intelligence sharing with foreign agencies should be regulated in “in full conformity with its obligations under the Covenant, in particular article 17, including the principles of legality, proportionality and necessity”, including putting in place “effective and independent oversight mechanisms over intelligence-sharing of personal data” and providing affected persons with effective remedies in cases of abuse.

Subject: State, National and International Emergency - Organized Stalking and Satellite Surveillance and Torture
Dear Governor Hickenlooper,
I wanted to make you aware of an emergency situation. Satellite technology is silently connected to millions of people, including children, throughout the world. It provides constant location, sight, sound and thought surveillance. The operators can literally hear what we hear, see what we see and read our thoughts. This technology is also being used as a remote, invisible torture instrument by transmitting inexplicable sounds, voices, images, smells and tastes directly into the brain, creating numerous pains and sensations throughout the body and significantly altering sleep patterns, energy level and emotional states. Many believe the technology has a “kill switch”, capable of causing instantaneous heart failure or a stroke. Everyone is potentially at risk. Imagine Hitler or Stalin with this technology.
Aaron Alexis, the Washington Navy Yard shooter, Miriam Carey, shot fleeing a White House checkpoint in October 2013, Dominic Adesanya, one of the recent White House fence jumpers, and Myron May, the shooter at Florida State University last November, were all targeted and tortured prior to those events. Eddie Ray Routh may have been targeted, tortured and provoked to kill Chris Kyle, the highly decorated Navy SEAL portrayed in American Sniper, and his friend Chad Littlefield. Many other seemingly inexplicable tragedies, including mass shootings going back decades, and an untold number of suicides have been caused by people being tortured past their breaking points. Once exposed, this will be the largest crime in U.S. history.
There are millions of satellite torture victims all over the world. Most do not even know this technology exists. Many are pushed into the mental health system. Over the past decade or so, information has sprung up everywhere – books, articles, websites, blogs, petitions, victim testimonials, support groups, etc. Published by torture victims trying to make sense of something almost impossible to comprehend, the information is understandably all over the board. Search “targeted individuals”, “organized stalking”, “gang stalking”, “electronic harassment” and “technological assault”. One prominent support group, Freedom from Covert Harassment and Surveillance (www.freedomfchs.com), was formed 10 years ago and has members and affiliated support groups across the country and throughout the world.
Since the satellite technology is classified and no information has been released to the public, there are many different theories regarding technological assault. However, any viable theory has to be able to explain how people are targeted on airplanes at 35,000 feet over the middle of the ocean. Satellite is the only technology that can do that.
Many victims of satellite surveillance and torture also experience “organized stalking”. This is stalking, monitoring, harassment and intimidation conducted by a large, organized, well-funded group. Organized stalking is a form of psychological torture which uses tactics similar to those used by corrupt regimes throughout history to manipulate and control their populations. The Germans had a name for the psychological terror inflicted by the Stasi in former communist East Germany – zersetzung or decomposition. American citizens in communities across the United States are being victimized by organized stalking. The size and scope of the organized stalking apparatus suggest government involvement and funding.
I have been a Colorado resident since 1999 and a victim of organized stalking and satellite surveillance and torture for roughly the past decade. I attached a copy of a paper I wrote in May 2014, “End the Torment”. It describes some of my personal experiences. I have reported these crimes to the Denver Police Department, the Douglas County Sheriff’s Office and the Summit County Sheriff’s Office. I have also contacted the FBI on numerous occasions. To my knowledge, no investigation has been commenced. The brutal torture continues every second of every day.
Victims across the country have filed reports with local and federal law enforcement. The crimes are not being investigated. It is being dismissed as mental illness. Torture victims are not only being ignored, they are often subjected to defamatory labels. It is NOT mental illness, yet the mental health profession continues to provide cover for these crimes by handing out false diagnoses and prescribing potentially dangerous, mind-altering drugs. The DSM and mental health practices will be completely revamped when this situation is finally exposed. The mental health profession has massive legal exposure, both civil and criminal, to this issue.
This is a state, national and international emergency. A long list of horrific crimes are being committed: unimaginable privacy violations, stalking, assault, torture, murder, domestic terrorism and crimes against humanity. American citizens are under attack, and innocent lives are being destroyed. This situation must be immediately investigated, and organized stalking and satellite technology capable of ending humanity must be exposed and permanently locked down.

Thank you for contacting the American Civil Liberties Union of Oregon. As you may know, the ACLU of Oregon is a small, private, non-profit organization funded entirely by private donations. Typically, the cases we accept are handled by lawyers in private practice who donate their time. As a result, we offer legal assistance in only a small number of cases each year.
Consequently, we must choose cases that most clearly invoke significant civil rights and civil liberties issues. We focus on protecting the rights of individuals to be free from excessive government intrusion and the right to receive equal protection under the law. These liberties include the rights of freedom of speech, press and religion, the right to be treated equally and without discrimination on the basis of race and sex, and the right to be free of abusive police conduct. Among these cases, we are forced to limit our representation to “impact cases” i.e., those that present new legal issues or affect large numbers of people.
We cannot assist in cases that depend on establishing facts. We are generally unable to get involved in disputes between private parties, with private employers, or private organizations. We also cannot intervene in a situation where an attorney has already been retained unless the attorney personally requests assistance, and even then, all the other criteria are still in place.
Based on the above criteria, we have concluded the ACLU is unable to provide you assistance. Please be assured, however, that this does not reflect on the worthiness of your case.

We do understand your concerns and desire that action be taken. However, our work is determined by the framework established by Amnesty International members at a global level, and all individual cases that we work on must fall within the terms established by our statute. This does not mean that we consider certain types of human rights, or human rights abuses, to be more important than others. Nor does it mean that we have reached any conclusion as to whether you may have been the victim of a human rights violation. Rather, it means that we must, to be as effective as possible, channel our limited resources towards those areas of work which we have identified as priorities.

Jared Loughner files rambling lawsuit alleging he is innocent of a 2011 shooting spree that killed six people and wounded 13, including Giffords
Five years after he went on a shooting spree that killed six people and wounded 13 others, Jared Loughner has filed a federal lawsuit against one of his victims, former U.S. Rep. Gabrielle Giffords.
In his rambling two-page complaint filed at the U.S. District Court in Phoenix, the convicted mass killer seeks $25 million from Giffords, whom he shot in the head on Jan. 11, 2011, outside a Safeway grocery store in Casas Adobes, Arizona.
Loughner, now 27, claims he was “framed” and was “handpicked illegally to be a sleeper assassin.” He says that “the govt. put a chip in my head to control my mind,” according to the Arizona Republic.

While awaiting trial, Loughner was diagnosed as schizophrenic, causing his case to be delayed until medical treatment rendered him competent. He eventually pleaded guilty to avoid a potential death sentence and, in November 2012, was sentenced to life plus 140 years in federal prison.
“My incarceration is illegal. I am actually innocent. I was Framed. I am a victim of project mk-ultra the govt. put a chip in my head to control my mind,” the former Pima Community College student wrote in the filing.
“Gabby Giffords never got shot, it was all an act, Giffords watches Ronald Reagan movies and pretened (sic) she was hit,” he continued.
The mass killer went on to refer to “the Illuminati,” which he claims Giffords is a member of, and says he is being subjected to “microwave testing” and waterboarding “on defendant’s direct orders,” and references the recent mass shooting in San Bernardino, California.

He also claimed that Mark Kelly, Giffords’ former astronaut husband, planted illegal spy equipment in the skies to spy on Americans.
Along with the rest of his grievances, Loughner complains that his prison food contains “no peppers, steaks, fruit juices,” and that he cannot get C-SPAN on TV.
Giffords, co-founder of the national gun-control organization, Americans for Responsible Solutions, was initially placed in a medically-induced coma and underwent cranioplasty surgery the following May to replace part of her skull that had been removed.

She was finally released from hospital that June, and continued speech, music, physical and occupational therapy from home.
Loughner is currently serving his life sentence at the Federal Medical Center, Rochester, Minnesota, which houses inmates with specialized health issues.

I have synthetic telepathy 24/7. They try to make me commit a suicide every day. They call me stupid, infernal, smart, crazy... They see my every thought and my dreams when I sleep. They comment them. There is no quiet moment. I get ugly treatment every where I go. People are mean. My family and friends are against me. My boyfriend is a stalker. NEWS ABOUT OUR COMPLAINT TO THE INTERNATIONAL CRIMINAL COURT - ICC
We had over 100 victims and supporters send petitions, information and/or their torture and abuse case summaries to the ICC.
And that’s just the number who have told me – hopefully many more sent things without telling me about it.
So now we can be sure, at least, that the ICC knows that these crimes are really going on and that there is a problem.
So does The International Committee of the Red Cross – ICRC, The United Nations High Commissioner For Human Rights – OHCHR and The Council of Europe – COE.
Thanks for all your participation and help – we just have to keep trying.
